Trademarks date back to before 1946 with the passing of the Lanham Act. The act was passetd to protect trademark owners. It outlines the federal statutes for trademark law in the United States.

A trademark can be a name, word, slogan or logo that is used to distinguish company’s products/services from one another. Some of the more famous trademarks are: the McDonald’s “Golden Arches”, the Nike “Swoosh” logo, the Facebook “F” and the Twitter “Bird.”

Registering a trademark will:

  • Protect the name, word, slogan or logo.

What is a trademark?

A trademark is intellectual property given over a brand name, slogan or logo. Once approved with the United State Patent & Trademark Office (USPTO), owners have exclusive rights to use that mark within the class of goods and services it is registered.

How much does a trademark cost?

The cost to register a trademark is $375 per trademark, per international class the mark is being registered in. If one mark is being registered in one class, the fee is $375. If one mark is being registered in 3 international classets the fee would be $1125 (3 classets x $375 =$1125).

Where are trademark applications filed?

All trademark applications are filed with the United States Patent & Trademark Office (USPTO).

What does registering a trademark do?

Registering a trademark gives the owner(s) exclusive rights to use that name, word, slogan or logo within a certain category of goods or services. Trademarking also establishes a federal record of ownership over a company, name, word, slogan or logo.

What is the difference between TM & ®?

TM can indicate one of 2 things; first it can be used to put people on notice that the mark is being used as a trademark. It can also mean that you are in the process and have filed for trademark approval with the United States Patent & Trademark Office. When a mark has an ® next to it, that means the trade mark is registered with the United States Patent & trademark Office and has federal protection.
